Stalking Charges in Atlanta, Georgia
In Georgia, there are two primary criminal offenses associated with stalking. These and their potential penalties are listed below:
Stalking - Georgia Code 16-5-90 (a)(1) states that "A person commits the offense of stalking when he or she follows, places under surveillance, or contacts another person at or about a place or places without the consent of the other person for the purpose of harassing and intimidating the other person."
In the State of Georgia, a stalking conviction will result in a misdemeanor, which is punishable by a maximum term of imprisonment in county jail for up to 12 months.
Aggravated Stalking - When a person commits stalking as defined above, in violation of a restraining order, protective order, probation or parole, good behavior bond, or permanent injunction, this is the offense of aggravated stalking.
Aggravated stalking is a felony in Georgia, and carries with it severe penalties of a prison term of up to ten years, as well as a monetary fine of up to $10,000.
