Homicide

Homicide is a situation in which one person kills another person. Even if a robbery is not committed with an actual firearm or weapon, a person may be charged with armed robbery, because in the State of Georgia a robbery which is committed with an offensive weapon, replica of a weapon, or device resembling a weapon is considered an armed robbery. Georgia Code 16-8-41states that "(a) A person commits the offense of armed robbery when, with intent to commit theft, he or she takes property of another from the person or the immediate presence of another by use of an offensive weapon, or any replica, article, or device having the appearance of such weapon. The offense of robbery by intimidation shall be a lesser included offense in the offense of armed robbery. (b) A person convicted of the offense of armed robbery shall be punished by death or imprisonment for life or by imprisonment for not less than ten nor more than 20 years."

Battery

A common definition of battery is "use of physical force with the intent of harming a person." As the harm must be intentional for battery to occur, actual injury does not need to be physical, it may be emotional, financial, or verbal to be considered battery.

Georgia Code 16-5-23(a) states that "A person commits the offense of simple battery when he or she either:

(1) Intentionally makes physical contact of an insulting or provoking nature with the person of another; or
(2) Intentionally causes physical harm to another."

Aggravated Assault

Aggravated assault is a crime in which a person illegally attempts to and is able to commit violence against another individual. Listed below are some examples of crimes which may constitute assault:

  • Assault with a deadly weapon
  • Assault with intent to cause serious physical pain
  • Physically attacking an individual
  • Threatening to cause physical harm
  • Causing fear in others by threats or endangerment
  • Intention to commit battery
